Introduction

1. General context 

According to ICAO Annex 13 (13th edition of July 2024), a safety recommendation is "A proposal of an accident investigation authority based on information derived from an investigation, made with the intention of preventing accidents or incidents and which in no case has the purpose of creating a presumption of blame or liability for an accident or incident. In addition to safety recommendations arising from accident and incident investigations, safety recommendations may result from diverse sources, including safety studies."

The provisions of regulation EU No 996/2010 reflect those of Annex 13.

The BEA addresses its recommendations to various entities including national and/or international authorities, manufacturers, operators or air navigation service providers. They must relate to the measures to be considered to prevent events that could occur in similar circumstances.

2. Follow up of safety recommendations

The provisions of regulation EU No 996/2010 require for European Union Member States, that the addressee of a safety recommendation acknowledge receipt of the transmittal letter and inform the safety investigation authority which issued the recommendation of the actions taken or under consideration, and where appropriate, of the time necessary for their completion and where no action is taken, the reasons therefor.

The addressee’s response must be addressed to the issuing authority within 90 days of receipt of a safety recommendation.

The issuing authority is under the obligation to inform the addressee, within 60 days of receiving its response, whether or not it considers it adequate. 

In addition to these regulatory obligations, the BEA follows up each recommendation which can lead to exchanges with the addressee until the decision to close the file is taken. The interval between a safety recommendation being issued and the closure of its follow-up file is variable, ranging from a few months to several years. Depending on the case, the file may be closed based on an agreement or disagreement with the addressee.

Recommendations issued by European Union Member States, as well as those issued by third countries to a European Union entity, are recorded and tracked via a European platform called SRIS2 (Safety Recommendation Information System 2).
